Father Stan Swamy dies at hospital waiting for bail

Priest-activist Father Stan Swamy passed away at Holy Family Hospital in Mumbai on Monday. He was 84 and was waiting for the hearing of his bail plea on the grounds of health issues. Father Sawmy has been in the hospital since May 28th following a court order after he tested positive for COVID19.

Seeking an urgent hearing on his plea, Father Swamy’s lawyers moved the Bombay High Court on Monday after the priest-activist’s health condition deteriorated sharply on Sunday and he was put on ventilation. His doctors have stated to the court that Swamy suffered a cardiac arrest on Sunday morning most probably due to post COVID complications, Parkinson’s disease and pulmonary infection.

The Jesuit priest was arrested last year in October under the Unlawful Activities (Prevention) Act in connection with the Elgar Parishad case. He is the oldest person to be accused of terrorism in India. 15 other lawyers, academics and activists were also charged under the heavily criticised draconian law. The NIA accused Swamy of helping the Communist Party of India (Maoist) through various civil rights organizations. The charges were repeatedly denied by Stan Swamy who stated that he was being targeted regarding his work related to the caste and land struggles of tribes in Jharkhand.

His health was already waning when he was charged with UAPA. He spent 9 months in Taloja Jail, Mumbai where his health condition worsened so much that he couldn’t even eat or clean himself. His several bail pleas on medical grounds were repeatedly denied. He requested a straw to drink water on the grounds of his Parkinson’s disease, but even that was declined. Criticism and anger sparked regarding the National Investigation Agencies continuous opposition against his release. The investigation has been called a ‘witch hunt’ by the government to silence its critics. According to Swamy’s counsel, Taloja prison authorities negligence and failure to provide Father Stan Swamy with immediate medical attention is one of the causes of his health condition worsening.
